Delaware Superior Court Judge Eric Davis has sanctioned Fox News for withholding evidence from Dominion Voting Systems relating to the defamation lawsuit which is set to go on trial in a few days.
The judge specifically noted that he was in a position to order a probe into any efforts made by the network and its lawyers to conceal or withhold evidence from Dominion’s team during the discovery process, according to a source who was in the courtroom during a pre-trial hearing on Wednesday.
Davis’s ruling came after Dominion’s lawyers played a recording that they had obtained through former Fox producer Abby Grossberg of Rudy Giuliani, a top aide to former President Trump, discussing with Fox employees. Dominion’s lawyers further alleged that during her time at Fox, Grossberg had gathered a lot more recordings that she had shared with the company’s legal team.
Grossberg is also suing Fox in a completely independent case after she was fired from the network earlier this year for alleging that she had been coerced by the network’s lawyers to provide false testimony in the Dominion case.
During her time at Fox, Grossberg had worked with a producer for Maria Bartiromo, Tucker Carlson, and other top hosts. She has claimed that she has now realized that the answers that Fox’s lawyers had been trying to put her in a position to be made her the “company scapegoat.” In a previously sworn deposition in Dominion’s case, Grossberg had claimed that she had not believed it was her duty to fact-check Trump’s false claims of widespread voter fraud.
