CA Doctors Sue Newsom Over New COVID Law

California prides itself on its liberal values. Democrats outnumber Republicans in the state 2-to-1, and it often leads the way in legislating social justice issues, environmental regulations, and other focal points of the Left. During the worst of the COVID-19 pandemic, the state took a hard-line stance against the spread of misinformation. Unfortunately, one law regulating doctors may have gone too far.

On November 1, a group of doctors in the Gloden State filed a lawsuit claiming that the “misinformation” law aimed at physicians violates their First Amendment rights. According to the suit, state law AB2098 amounts to censorship and disrupts communications between physicians and patients. The law restricts doctors from offering treatment information about COVID, including vaccination, except for state-approved options. The law categorizes anything else as “unprofessional conduct” and provides for disciplinary consequences.

Another concern is that the law leaves disciplinary action against doctors who don’t follow the status quo to the letter to a panel of 15 people, 7 of whom aren’t physicians. According to the suit, that brings into question due process as guaranteed under the 14th Amendment.

The New Civil Liberties Alliance (NCLA) and its lawyers are behind the suit. In a statement, the organization said doctors fear they won’t be able to provide their patients with all the information they need, as they may not want to walk near the line of constantly changing “common consensus.”
